The Unit for the Victims recalls that, to validate the disability prioritization criteria for the acknowledgement and granting of administrative compensation, it is required, in accordance with 2019’s 1049 Resolution, that the victim submit one of the following documents to the Unit:
1. Disability certificate issued within the 2019’s 113 Resolution framework.
2. Disability certificate issued within the Health Superintendency’s framework, provided it has been issued before June 30th, 2020. This document is valid and will be received until December 31st, 2021.
3. Clinical history summary or epicrisis.
4. Evidence or medical concept that meets the 2017’s 009 Circular six requirements; it has to have been issued before or after June 30th, 2020.
It is worth noting that the documents issued by private doctors such as medical formulas, medical prescriptions or medication orders do not prove a disability.
Likewise, to give the administrative compensation acknowledgment to the victims with disabilities, and to guarantee their legal capacity right and support access to it, the Unit for the Victims has established the following mechanisms and measures:
1. The Unit will continue to support the victims to determine how to help in the compensation delivery, when applicable, through the “Support Assessment Instrument”.
2. In the event the victim had, in a voluntarily manner, resorted to the 2019’s 1996 Law support mechanisms, and as a result obtained the conciliation act, the public deed or the court ruling, in that case this documentation will be valid for the Unit and no additional appraisal will be required.
The Unit clarifies that other documents are not required, such as, for example, the qualification of loss of work capacity issued by the Regional Boards.
The Unit promotes the victims with disabilities rights guarantee through different mechanisms, which seek to eliminate access barriers to the measures established in the Victims and Land Restitution Law.
