En 1991 en Colombia se estrenaba la Constitución que consagró un amplio capítulo de Derechos Humanos. Paradójicamente, el 26 de agosto de ese mismo año, tan solo 52 días después de haberse promulgado la Carta Magna, Emilia Velásquez Pérez y su familia enfrentaban el peor caso de violación de sus derechos como ciudadanos y seres humanos.
Las noticias eran confusas. En los medios locales se anunciaba una masacre de campesinos en San José de las Hermosas, uno de los cinco corregimientos de Chaparral, en el sur del Tolima, enclavado entre dos espesas y extensas montañas que se rinden ante la fuerza del caudal de los ríos Amoyá y Davis. Un paraíso natural, pero también por muchos años el centro de operaciones del Frente 21 de la extinta guerrilla de las FARC.
La noche del domingo de ese 26 de agosto, Éver Devia Osorio, esposo de Emilia, compartió unos tragos con su hermano Ovidio y Lucas Velásquez Pérez, su cuñado, hermano de Emilia. En la madrugada llegaron a dormir a la finca La Linda, su lugar de trabajo desde hacía cinco meses. Tal vez no habían conciliado el sueño cuando las ráfagas de fusil de un grupo de guerrilleros impactaron la casa y a todo aquel se moviera.
“Mi cuñado Ovidio fue el primero en caer y su esposa Marleny Echeverry recibió dos tiros cuando intentó auxiliarlo. Ella murió desangrada. A mi esposo y a mi hermano los asesinaron cuando intentaron correr”, relata Emilia.
Solo se salvaron cuatro niños y una mujer. Nadie supo con precisión cuántas fueron las víctimas. El silencio, como era costumbre en estas zonas, también se convertía en cómplice.
“A mi suegro, la Policía y el Ejército lo único que le dijeron era que los habían matado a todos”, recuerda.
Por versiones ambiguas, Emilia, que para esta fecha se encontraba en un hospital de Armenia tras dar a luz a Luis Felipe, su segundo hijo con Éver, se enteró que a sus familiares los habían enterrado en un fosa común tres días después de la masacre.
“Dicen que era un lago seco, una piscina al lado de la Estación de Policía y que la misma gente del pueblo los ayudó a tapar”, señala.
La búsqueda
Hasta solo dos años después de lo sucedido, la mamá de Emilia y de Lucas, pudo ingresar al caserío. Encontrar los cuerpos se convirtió desde entonces en un angustioso y eterno duelo.
La zona estaba dominada por la guerrilla y para las autoridades era un caso más, que en poco tiempo terminaría archivado “los relacionaron hasta con un grupo armado ilegal, llamado Atá Rojo”, señala.
Revictimizados, así se sentían. El dolor era mayor y la búsqueda también se convirtió una lucha por recobrar la honorabilidad de sus familiares “quien más que nosotros mismo sabíamos quién eran ellos, si fueran delincuentes no estarían allí con niños”, afirma.
Pasó el tiempo y en medio de la estigmatización, la falta de apoyo de las entidades y el miedo, solo hasta en el año 2008, se entabló una primera denuncia y partir de entonces, el caso fue cerrado en cuatro oportunidades “nos decían que por inhibitorio ya que nadie se había atribuido los hechos”, recuerda.
A punto desistir y agotados, en el 2011 acudieron a la recién creada Unidad para las Víctimas y fue en esta entidad en la que asegura Emilia, la mano del Estado empezó a estar de su lado “a mí me atendieron muy rápido fui muy afortunada, en menos de seis meses me indemnizaron, pero además siempre nos han brindado acompañamiento psicosocial y el apoyo en el procesos de búsqueda”, reconoce.
Entre los años 2019 y 2020, y luego de que se reactivara el proceso, llegaron nuevamente las esperanzas de poder cerrar el duelo. En estos dos años un fiscal ordenó la búsqueda primero en bajo el cimiento de los baños de la escuela de San José de las Hermosas y en el segundo intento en un patio aledaño. Diligencias que no arrojaron resultados.
En el 2021, el equipo forense regresó. La prospección esta vez contó con el “georadar” para la toma de imágenes gráficas del subsuelo, una ayuda tecnológica en la que estaban puestas todas las la esperanzas de la familia. Sin embargo y aunque se realizó una excavación de tres metros en el punto del comedor de la institución educativa tampoco se halló evidencia de los restos “la versión del fiscal y del antropólogo es que pudo ser que a los cuerpos los deterioró la tierra y nos dijeron que por parte de la Fiscalía ya no habrá más búsqueda, que nos van entregar un acta defunción con la que se certifica que ellos están muertos”, afirma
Dice que junto a su familia comprenden y agradecen la labor de la Fiscalía, y aunque han pensado desistir de la búsqueda, para ella hay un duelo imprescriptible como el mismo delito: “Para mí, ellos siguen desparecidos”.
La resiliencia
Sometida por un delito continuo y permanente, la desaparición forzada deja en Emilia una huella imborrable de sufrimiento. Una amargura que solo ha encontrado regocijo en el amor de sus cuatros hijos: Walter Steven, Luis Felipe, Jennifer y Luisa Fernanda. Con ellos y con la reparación económica entregada por la Unidad para las Víctimas compró una casa y fundó hace 10 años la empresa de confecciones “Subl&confe”.
“Y nos ha ido muy bien porque trabajo con mis dos hijas y generamos empleo para otras personas. Hacemos sublimación personalizada en vasos, camisetas y gorras. Además, confeccionamos uniformes y en esta época de pandemia tuvimos que reactivarnos haciendo tapabocas”, asegura.
Pero no sólo es empresaria. Emilia también lucha por los derechos de las demás víctimas del conflicto a través de su corporación Famdesvul. “Tenemos más de 60 familias vulnerables, y para ellas trabajamos en la consecución de empleos, programas de vivienda, acceso a la educación y en todo lo que se pueda para mejor la vida de estas personas”, afirma.
Esa capacidad de trabajo y de resiliencia, llevó a Emilia entender que su vida es un patrón a seguir. Por eso en medio de su dolor, pero también de esa tenacidad, decidió por primera vez contar su historia y rendir un homenaje a las 185.843 víctimas de desaparición forzada que como ella batallan en Colombia por encontrar a sus seres queridos y consumar un duelo.
“A todos ellos le digo que nos desfallezcan, que insistan, que continúen buscando a sus familiares. Y a los victimarios, que piensen en las personas, que piensen en ellos y sus familias”, concluyó.
Para tener en cuenta
La desaparición forzada es un delito penal prohibido por la Ley 589 de 2000, recogido en el artículo 165 del Código Penal colombiano. Es un delito imprescriptible, lo que supone que el delito y la acción penal derivada del mismo no desaparecen por el paso del tiempo.

Screen reader and keyboard navigation
Our website implements the ARIA (Accessible Rich Internet Applications) attribute technique, along with several different behavior changes, to ensure that blind users who visit with screen readers can read, understand, and enjoy the features of the website. As soon as a user with a screen reader enters your site, they are immediately prompted to enter the screen reader profile so they can effectively navigate and operate your site. Here's how our website covers some of the most important screen reader requirements, along with console screenshots of code examples:
Screen Reader Optimization: We run a background process that learns website components from top to bottom, to ensure continued compliance even when the website is updated. In this process, we provide screen readers with meaningful data using the ARIA attribute set. For example, we provide accurate form tags; actionable icon descriptions (social media icons, search icons, cart icons, etc.); validation guide for form inputs; roles of elements such as buttons, menus, modal dialogs (popups), and others. In addition, the background process scans all images on the website and provides an accurate and meaningful description based on Image Object Recognition as an ALT (alternative text) tag for images that are not described. It will also extract texts that are embedded within the image, using an OCR (Optical Character Recognition) technology. To activate screen reader settings at any time, users just need to press the Alt+1 keyboard combination. Screen reader users also receive automated prompts to activate screen reader mode as soon as they enter the website.
These settings are compatible with all popular screen readers, including JAWS and NVDA.
Keyboard navigation optimization: The background process also adjusts the HTML of the website and adds various behaviors using JavaScript code to make the website work with the keyboard. This includes the ability to navigate the website using the Tab and Shift+Tab keys, operate dropdown menus with the arrow keys, close them with Esc, activate buttons and links using the Enter key, navigate between radio items and checkboxes using the arrow keys and complete them with the space bar or the Enter key. In addition, keyboard users will find quick navigation and content skip menus, available at any time by clicking Alt+1, or as the first site elements while navigating with the keyboard. The background process also handles triggered popups by moving keyboard focus to them as soon as they appear, and not allowing focus to drift away from it.
Users can also use shortcuts such as "M" (menus), "H" (headers), "F" (forms), "B" (buttons), and "G" (graphics) to jump to specific items.
Disability profiles accepted on our website
Epilepsy Safe Mode: This profile allows people with epilepsy to use the website safely by eliminating the risk of seizures resulting from flashing or flickering animations and risky color combinations.
Visually Impaired Mode: This mode adjusts the website for the comfort of visually impaired users such as impaired vision, tunnel vision, cataracts, glaucoma, and others.
Cognitive Impairment Mode – This mode provides different support options to help users with cognitive impairments such as dyslexia, autism, AVC, and others to focus on the essential elements of the website more easily.
ADHD Friendly Mode – This mode helps users with ADHD and neurodevelopmental disorders to read, navigate, and focus on the main elements of the website more easily, while significantly reducing distractions.
Blind Mode – This mode configures the website to be compatible with screen readers such as JAWS, NVDA, VoiceOver, and TalkBack. A screen reader is software for blind users that is installed on a computer and smartphone, and websites must be compatible with it.
Keyboard Navigation Profile (Motor Disability): This profile allows people with motor disabilities to operate the website using the Tab, Shift+Tab, and Enter keys on the keyboard. Users can also use shortcuts such as "M" (menus), "H" (headers), "F" (forms), "B" (buttons), and "G" (graphics) to jump to specific items.
Additional UI, layout, and readability tweaks
Font Settings: Users can increase and decrease its size, change its family (type), adjust spacing, alignment, line height, and more.
Color Settings: Users can select various color contrast profiles, such as light, dark, inverted, and monochrome. Additionally, users can swap title, text, and background color combinations, with more than 7 different color options.
Animations: Epileptic users can stop all running animations with the click of a button. Interface-driven animations include videos, GIFs, and flashing CSS transitions.
Content Highlighting – Users can choose to emphasize important elements like links and titles. They can also choose to highlight only focused or suspended items.
Audio Mute: Users with hearing aids may experience headaches or other issues due to autoplay of audio. This option allows users to mute the entire website instantly.
Cognitive disorders: We use a search engine that is linked to Wikipedia and Wiktionary, allowing people with cognitive disorders to decipher meanings of phrases, initials, slang, and others.
Additional features: We provide users with the option to change the color and size of the cursor, use a print mode, enable a virtual keyboard, and many other features.
Browser and assistive technology support
Our goal is to support the widest possible range of browsers and assistive technologies, so our users can choose the tools that work best for them, with as few limitations as possible. Therefore, we have worked very hard to be able to support all the major systems that comprise more than 95 % of the user market share, including Google Chrome, Mozilla Firefox, Apple Safari, Opera and Microsoft Edge, JAWS and NVDA (readers). screen), for both Windows and MAC users.
